These Terms and Conditions set out the basis on which Waste Clearance South Kensington provides waste collection and related services. By making a booking, confirming a quotation, or allowing our operatives to commence work at your premises, you agree to be bound by these Terms and Conditions.

Definitions

In these Terms and Conditions, the following expressions have the meanings given below.

Company means Waste Clearance South Kensington, the provider of waste clearance and related services.

Client means any individual, business, landlord, tenant, property manager or organisation requesting or receiving services from the Company.

Services means any waste clearance, rubbish removal, bulky waste collection, household waste collection, commercial waste collection, garden waste removal, or related services provided by the Company.

Premises means the address or location at which the Services are to be provided.

Waste means any items, materials, refuse or goods that the Client asks the Company to remove, subject to applicable laws and these Terms and Conditions.

Scope of Services

The Company provides on-demand waste clearance and collection services for domestic and commercial Clients. Services may include the removal of general household waste, office waste, small-scale builders waste, garden waste and bulky items, in accordance with applicable waste regulations and the Companys licence conditions.

The Company does not provide skip hire or large-scale demolition services unless specifically agreed in writing. The Company reserves the right to decline any job that, in its reasonable opinion, is unsafe, unlawful, unsuitable for its operatives or vehicles, or beyond its operational capacity.

Booking Process

Clients can request Services by telephone, email or other communication channels offered by the Company from time to time. When making a booking, the Client must provide accurate information regarding:

1. The Premises address and any access restrictions.

2. The type and approximate volume or weight of waste to be collected.

3. Any hazardous or specialist items that may be present.

4. Preferred collection date and time window.

The Company will provide an estimated quotation based on the information supplied. All quotations are subject to change if, on arrival, the quantity, type or location of the waste differs from the description given at the time of booking.

A booking is regarded as confirmed once the Client accepts the quotation and the Company confirms the date and time window for attendance. The Company reserves the right to reschedule or cancel a booking where necessary due to operational or safety reasons, in which case reasonable efforts will be made to notify the Client.

Access and Client Responsibilities

The Client must ensure that the Company and its operatives have safe, lawful and reasonable access to the Premises at the agreed time. This includes providing suitable parking, entry codes, permissions for gated areas, and any necessary instructions for reaching the waste.

The Client or an authorised representative should be present at the Premises during the collection unless otherwise agreed in advance. If prior arrangements have been made for unattended collections, the Client is responsible for clearly identifying and separating the waste to be removed.

If the Company is unable to carry out the Services due to lack of access, incorrect address details, or safety concerns arising from the condition of the Premises, a call-out or cancellation charge may apply.

Waste Types and Restrictions

The Company is licensed to carry general non-hazardous waste. Certain items are restricted or require special handling, including but not limited to:

1. Asbestos and materials containing asbestos.

2. Clinical or medical waste.

3. Chemical waste and solvents.

4. Oils, fuels and other flammable liquids.

5. Gas bottles and pressurised containers.

6. Hazardous electrical equipment requiring special treatment.

7. Any waste classified as hazardous under UK law.

The Client must declare any such items at the time of booking. The Company may agree to remove certain restricted items subject to additional charges, specialist arrangements and compliance with waste regulations. The Company reserves the right to refuse to collect any waste that it reasonably believes to be hazardous, illegal, contaminated or not as described.

Pricing and Quotations

Prices are usually based on a combination of the volume of waste, the weight of waste, the type of waste, the labour involved and any additional disposal or processing charges. Quotations given prior to attendance are indicative and may be adjusted on site once the waste has been inspected.

If the volume or type of waste exceeds that described by the Client, the Company will explain any change in pricing before proceeding. If the Client does not agree to the revised price, the Company may cancel the job or remove only the agreed portion of the waste, subject to any applicable minimum charge or call-out fee.

All prices quoted by the Company are exclusive of any applicable taxes unless specifically stated otherwise. The Company reserves the right to amend its pricing structure and rates at any time, but such changes will not affect confirmed bookings already accepted by the Client.

Payments and Invoicing

Payment is due in full upon completion of the Services, unless otherwise agreed in writing in advance. The Company accepts various payment methods, which may include cash, card payments or bank transfers, subject to availability at the time of service.

Where credit terms have been agreed for commercial Clients, invoices are payable within the period stated on the invoice. If no period is stated, payment must be made within 14 days from the invoice date.

The Company reserves the right to charge interest on overdue amounts at the statutory rate permitted under UK law, accruing daily until payment is received in full. The Client will be responsible for any reasonable costs incurred by the Company in recovering overdue payments, including legal fees and collection agency charges.

Cancellations and Amendments

The Client may cancel or amend a booking by contacting the Company. To avoid a cancellation charge, the Client must provide a minimum of 24 hours notice prior to the scheduled collection time, unless otherwise agreed. Cancellations made with less than 24 hours notice may be subject to a reasonable cancellation fee or minimum charge, to cover the Companys costs.

If the Client is not present at the Premises at the agreed time and access to the waste is not possible, the Company may treat the booking as cancelled and apply a call-out charge. If the Client wishes to rebook, a new appointment will be scheduled and may incur additional charges.

The Company may reschedule or cancel a booking at any time due to vehicle breakdowns, staff shortages, severe weather, safety concerns or other circumstances beyond its reasonable control. In such cases, the Company will endeavour to offer a new appointment at the earliest convenient time. The Company will not be liable for any indirect or consequential loss arising from such rescheduling or cancellation.

Performance of Services

The Company will carry out the Services with reasonable care and skill, in accordance with industry practice and applicable waste regulations. Operatives will load the waste into the Companys vehicles and remove it from the Premises. Unless expressly agreed, the Services do not include detailed cleaning of the area from which waste has been removed.

The Company will dispose of all collected waste at authorised facilities in compliance with UK environmental and waste management regulations. The Client acknowledges that, once collected, the waste becomes the responsibility of the Company and will be sorted, recycled or disposed of in accordance with lawful and environmentally responsible procedures.

Client Warranties

The Client warrants and represents that:

1. They are the owner of the waste or are otherwise authorised to arrange its removal.

2. The waste does not contain any hazardous items unless previously declared.

3. The information provided to the Company regarding the waste and Premises is accurate and complete.

4. Access to the Premises is lawful, safe and suitable for the Companys personnel and vehicles.

The Client agrees to indemnify the Company against any claims, losses, damages or penalties arising from a breach of these warranties, including any illegal or improper disposal arising from undeclared hazardous items.

Liability and Limitations

The Company will not be liable for any damage to the Premises or property where such damage arises from pre-existing defects, structural weaknesses, difficult access, or from moving items at the Clients request in tight or restricted spaces, provided the Company has exercised reasonable care.

It is the Clients responsibility to protect floors, walls, doorways, fixtures and fittings as necessary. The Company will take reasonable care but cannot guarantee that minor scuffs or marks will not occur where large or heavy items must be removed through confined spaces.

The Company is not liable for the loss of any item mistakenly included in the waste collection. The Client should ensure that all items to be retained are separated from the waste prior to the arrival of the Companys operatives.

Nothing in these Terms and Conditions limits or excludes the Companys liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under UK law.

Subject to the preceding paragraph, the Companys total liability to the Client for any claim arising out of or in connection with the Services shall be limited to the total price paid or payable for the specific Services giving rise to the claim. The Company shall not be liable for any indirect, consequential or purely economic loss, including loss of profit, loss of business, loss of opportunity or loss of reputation.

Waste Regulations and Compliance

The Company operates in accordance with applicable UK waste management regulations, including registration as a waste carrier where required. All waste is transported and disposed of at licensed or authorised facilities. The Company maintains records of waste transfers as required by law.

The Client agrees not to request or require the Company to undertake any action that would contravene waste legislation or environmental regulations. If the Company reasonably believes that compliance with the Clients request would breach any law or regulatory requirement, the Company may refuse to perform that part of the Services without liability.

Force Majeure

The Company will not be in breach of these Terms and Conditions or otherwise liable for any failure or delay in performing its obligations where such failure or delay results from events, circumstances or causes beyond its reasonable control. This may include, without limitation, adverse weather, traffic disruption, accidents, strikes, lockouts, breakdowns, acts of God, or restrictions imposed by authorities.

Data Protection and Privacy

The Company will collect and process personal data provided by the Client for the purpose of managing bookings, providing Services, processing payments and complying with legal obligations. The Company will take reasonable steps to protect such data and will not share it with third parties except where necessary for the provision of Services, payment processing, debt recovery or where required by law.

Complaints and Disputes

If the Client is dissatisfied with any aspect of the Services, they should notify the Company as soon as reasonably practicable, providing full details of the issue. The Company will investigate and endeavour to resolve the complaint promptly and fairly.

If a dispute cannot be resolved amicably, either party may pursue its rights through the courts, subject to the governing law and jurisdiction clause set out below.

Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them, or with the provision of the Services, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

Variation of Terms

The Company may update or amend these Terms and Conditions from time to time. Any changes will apply to bookings made after the updated Terms and Conditions have been published or communicated to the Client. The version in force at the time of the Clients booking will apply to that booking.

Severability

If any provision of these Terms and Conditions is held to be invalid, illegal or unenforceable by a court of competent jurisdiction, that provision shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision shall be deemed deleted. Any such modification or deletion shall not affect the validity and enforceability of the remaining provisions.

Entire Agreement

These Terms and Conditions, together with any written quotation or confirmation issued by the Company, constitute the entire agreement between the Company and the Client in relation to the Services. They supersede all prior discussions, correspondence, understandings or agreements relating to the same subject matter.

By placing a booking with Waste Clearance South Kensington, the Client confirms that they have read, understood and agree to be bound by these Terms and Conditions.
